Definition - Tickets - Conduct

By purchasing tickets and/or entering or attempting to enter the Venue, you will be deemed to have accepted these Terms and Conditions in full. Your admission to an Event organised by us is governed by these Terms and Conditions.

Definitions and Interpretation
In these Terms, certain words have specific meanings, as follows:

The term "us" or "we" or "our" refers to Gatecon Limited registered as a limited liability company in England & Wales.
The term "you" or "your" refers to any person seeking admission to our Events or any Venue to attend our events
The term "event" or "events" refers to a live event operated by or on behalf of us taking place at any venue.
The term "ticket" or "tickets" refers to a ticket, electronic ticket, wristband or any other device giving the bearer the right to attend an event.
The term "venue" or "venues" refers to the location and/or any other area in which our Events take place.
The term "terms" refers to these terms and conditions.

Tickets
A legally binding contract will come into existence when we accept your order. Acceptance of an order placed by you is subject to the condition that tickets are available for the event at the time of processing. Tickets ordered by you for payment with PayPal will be held for a period of 24 hours and tickets ordered for payment to be made by other means, will be held for a period of up to 14 days after order acceptance to allow your payment to reach our bank accounts. If payment, for either the full amount or the first instalment of a payment plan, is not received within this period the tickets may, at our sole discretion, be released for resale. It is your responsibility to make your payment/s without delay, we cannot be held responsible or liable for any delays, either delayed payment by you or for any delay in the banking system which results in your payment not reaching our bank account within the stated time period. The person making payment for tickets is responsible for all fees incurred during the chosen payment process. Any fees, if applied by the payment processor, should not be marked as payable by Gatecon.

For security reasons we require the name of ALL ticket holders at the time of purchase.
Your ticket may be provided in the form of paper, mobile/bar code, email, wristband or chip technology or such other form that becomes available over time. Tickets are non-transferable, non-refundable and cannot be cancelled.

Only persons holding a valid ticket will be admitted to an event, and tickets must be kept with you at all times during an event. If any part of your ticket is removed, altered in any way or defaced your ticket could be invalidated.

Tickets should be kept safe at all times, if you lose your tickets or they are stolen, we may not be able to replace them and we will not be liable for any lost or stolen tickets.
Tickets usually include entry to most, but not necessarily all, areas of the event. Subject to availability and at our absolute discretion, visitors may be asked to purchase additional tickets to obtain access to other areas or attractions within the event.

You are advised to check your purchase upon receipt and inform us of any errors as soon as possible. Please note that all event ticket sales are final and no refunds will be given so please be sure of your booking.

If the event is sold out whereby we have no tickets left for sale we will allow the transfer or resale of tickets to persons on the waiting list should such a list exist at that time. Private resale or transfer of tickets is not allowed and can render the ticket null and void. If you are unable to attend the event Contact Us directly by email. We will endeavour to put you in touch with someone on the waiting list should such a list exist at that time.

It is the responsibility of you to inform us of any change of your contact details. Please note that our preferred method of contact for customers booking online is by email, so care should be taken to provide a current and valid email address. You understand that Gatecon will use your email address to send out periodic convention updates and information we think will be of interest.

If the holder of a ticket has any special needs, you must contact Gatecon at the time of purchasing your ticket to submit a request. Any special needs must be submitted to Gatecon by email no later than one month before the scheduled start date of the convention attending.

Conduct
Whilst you and other ticket holders for which you are responsible for are at an event, you and your guests must comply with all directions of our staff, volunteers, relevant health and safety notices, and other policies and announcements made available to you during your visit.

Any breach of these terms or any unacceptable behaviour by you or your guests deemed so by us, the Venue management or a member of our staff may result in immediate ejection from the event and venue.

We shall have the right to refuse admission or to eject you and any other ticket holder from the event if in our reasonable opinion, granting you admission might be a risk to our property, the safety of others and/or affect the enjoyment of the event by others and in particular (but without limitation) where there is a breach of the following rules:

• No smoking in the venue;
• No offensive weapons;
• No access to any area of the event other than areas designated for access by you;
• No unnecessary noise (whether from mobile phones or other devices) or behaviour likely to annoy or
offend other visitors or intimidate our staff or volunteers;
• No use of illegal drugs
• No consumption of alcohol except in authorised places.

No refunds will be offered to ticket holders who are refused entry or ejected from the event under these terms.

Event Alteration, Cancellation and Postponement
From time to time we make alterations to an event which is not material in nature and no refunds will be available in respect of non-material alterations. A "material" change is a change to an event which in the reasonable opinion of us, makes the event materially different to the event which purchasers of the ticket could reasonably expect.

Changes to performance times, guest appearances, guest cancellations and changes to scheduled panels and attractions will not be a material change. A material change is judged by reference to the nature and billing of each event. Events which are themed Events are judged by reference to the overall theme rather than the individual guest or attraction scheduled to appear. This includes Events which have multiple guests and/or where the event name does not include reference to any specific guest or attraction. In these cases, no scheduled guest or attraction may be considered as headline acts, regardless of their relative fame or prominence in the billing.

If we unilaterally cancel, postpone or effect a material change to an event you may be entitled to a refund in accordance with these terms. However, this will not be the case if cancellation, postponement or a material change is imposed upon us by a third party. No refunds will be issued directly to you by us unless your ticket(s) were purchased directly from us.

It is your responsibility to check our website for News of any alteration, cancellation or postponement of the event. Information on such matters will be made available on behalf of us as soon as reasonably practicable on our website and social media. Should an event be postponed or cancelled, we cannot be held liable for any additional costs you may incur for personal arrangements such as travel, accommodation, subsistence or any other associated service relating to the event.
All guests appearances are subject to work and personal commitments.

Hotel No Smoking Policy
The Sheraton Vancouver Airport hotel has a zero smoking policy and anyone who is found to have been smoking in their bedroom will incur a $200 cleaning charge on their final account, charged by the hotel directly.




Event - Security - Photography

Security
In the interests of safety, you may be asked to submit to a search of your person or belongings and anyone refusing to submit or found to be in possession of materials which we believe to be dangerous or unsuitable will be denied entry or removed from the event. You understand that there is a need for a high security presence at the convention for guest security. The security high presence ensures greater availability of the stars whilst at the convention.
You must keep your personal belongings with you at all times. In the absence of any negligence or other breach of duty by us, we accept no responsibility for loss, theft or damage to any personal belongings brought into the event. In addition, should your unattended personal belongings be deemed a threat and cause an emergency at the Venue we will accept no liability on your behalf or contribute to any ensuing damages claim by others.

Photography
You understand that there are no guarantees in obtaining a guests autograph or photograph. Autograph and photograph sessions are time based, and doors will be closed promptly upon completion of the current session. Gatecon makes no guarantees on which guests will be available for each autograph or photograph session. From time to time we or other authorised third parties may carry out photography, filming and/or other recordings at events, and any images and/or recordings captured may feature our visitors and/or guests.

By purchasing a ticket to an event and/or attending an event, you give your express consent to the use of such images and/or recordings by us in connection with advertising and promotion (such as on our website, social media sites and pages, partner sites, outdoor advertising and brochures), commercial purposes (such as merchandising, DVDs and Blu-Ray or digital media recordings) and for other internal purposes, and in doing so, you allow us to edit, modify, publish and make available such images and/or recordings. You acknowledge and agree that you will not receive payment or compensation if we use such images and/or recordings for the purposes set out above. If any visitors to our Events are under the age of 18, you, being the parent or legal guardian of such persons, also consent to the use of their image and/or recordings for the purposes set out above. You acknowledge that the copyright and all rights in such images and/or recordings rests with us and/or any authorised third party and accordingly you grant us and/or any authorised third party all rights in any images and/or recordings of you and/or your children. You shall promptly execute such documents and perform such acts as may be required for the purposes of giving full effect to the foregoing.

The taking of photographs with personal cameras is allowed in all areas at our Events apart from any professional photo shoot areas.

Video recording or streaming as well as the use of tripods and other specialist photographic equipment is not permitted. Flash photography is only permitted for the first five minutes of a panel.

Photographs are for you to enjoy for your own personal, private and non-commercial purposes only. Unless permission has been granted by us, pictures and images cannot be reproduced in any format or media other than for private viewing

Liability - Delivery - Returns

Liability
Our liability for losses you suffer as a result of us breaching a contract between us is strictly limited to an amount up to or equal to the face value of the ticket purchased by you for the event you are attending. We will not be liable to you for loss or expenses incurred in connection with your visit to the event, its alteration, postponement or cancellation, such as the cost of any personal travel, accommodation or hospitality arrangements made in connection with any event.

Where part of the services you have paid for in connection with the event are provided by a third party supplier, that supplier’s individual liability will be set out in their own terms and conditions. You may request from the supplier directly copies of any relevant terms and conditions. For the avoidance of doubt, we do not accept liability for acts or omissions by you or any person(s) on behalf of whom you have placed a booking or unconnected third parties or suppliers of services which do not form part of the contract between you and us.

Force Majeure
Subject to applicable law, we shall have no liability to you if we are prevented from, or are delayed in performing our obligations under any contract or from carrying on our business by acts, events, omissions or accidents beyond our reasonable control, including (but not limited to) strikes, lock-outs or other industrial disputes, failure of a utility service or transport network, act of God, war, riot, civil commotion, malicious damage, compliance with any law or government order, rule, regulation or direction, accident, breakdown of plant or machinery, epidemic, pandemic, fire, flood, storm or default of suppliers or subcontractors.

Delivery Policy
Ticket purchases will receive a confirmation email containing order number and event information. Tickets will be available for collection at the registration table of the convention you are attending. Merchandise including DVD's, t-shirts etc. will either be despatched within 14 days of receipt and full payment of the order or will be available for collection at the event . Some items may take longer to despatch including pre-orders and items still in production. In these cases, an expected shipping date will be clearly included in the item description in the Gatecon store.

Return Policy
Returns are only available on items that ARE NOT convention tickets or Events as part of a Gatecon convention. If a product is faulty, please Contact Us at info@gatecon.com to organise a replacement or refund of your product. Replacements require the return of the faulty items before a replacement will be issued. For your convenience, Gatecon has return points in United kingdom and Australia, with other return points coming soon. See the Contact Us page for your nearest Gatecon return point. In the case of a product refund, the total price refunded will the less any postage charges. Gatecon will ONLY refund on faulty or damaged items.

Convention Tickets have a NO REFUND policy. Please read the ticketing Agreement at the top of this page before purchasing a Gatecon convention ticket.

General
We have the right to revise and amend these terms from time to time. To the fullest extent permissible by law, we shall be entitled to assign any and all of our rights and obligations under these terms, provided that your rights are not adversely affected. If any provision of these terms is found to be invalid or unenforceable by a court, the invalid or unenforceable provision shall be severed or amended in such a manner as to render the rest of the provision(s) and remainder of these terms valid and enforceable. If we delay or fail to enforce any of these terms it shall not mean that we have waived our right to do so.

All of these terms are governed by English Law and any disputes arising under them are subject to the non-exclusive jurisdiction of the English Courts.
